RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

In consideration of participating in YMCA activities, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence the YMCA of the North (hereinafter referred to as YMCA) and its owners, directors, officers, employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as “Releasees”), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:

  1. I acknowledge that participating in YMCA activities involves known and unanticipated risks which could result in physical or emotional injury, illness, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, broken bones, torn ligaments or other injuries as a result of falls or contact with other participants; death as a result of drowning or brain damage caused by near drowning in pools or other bodies of water; medical conditions resulting from physical activity or exposure to infectious diseases such as COVID-19; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment and increased cleaning, sanitation and physical distancing, without jeopardizing the essential qualities of the activity.
  2. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My/My child’s participation in these activities is purely voluntary and we elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I or my child are unable to participate due to physical or medical conditions, then I will immediately discontinue participation.
  3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with my/my child’s participation in these activities, or our use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct or conduct that constitutes greater than ordinary negligence. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  4. I represent that I have adequate insurance to cover any injury or damage I or my child may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I/my child have no medical or physical conditions which could interfere with our safety in these activities, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
  5. In the event that I file a lawsuit, I agree to do so in the state where Releasees’ facility is located, and I further agree that the substantive law of that state shall apply.

I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.


Parent/Guardian Authorization - Transportation/Medical

  1. In the event that I/my child need immediate medical attention for injuries or illness that may occur while participating in a YMCA program, I authorize the YMCA staff to give me or my child reasonable first aid, and to arrange transport of myself or my child to a health care facility for emergency services as needed.  I understand that I may be asked to isolate myself or my family and may be asked to leave a program early if I display symptoms of illness such as COVID-19.
  2. I give permission for myself and/or my child to be transported by the YMCA as needed for field trips, inclement weather, or late pick up. I also give my permission to participate in walking field trips.
  3. I also give permission for myself or my child to enter Canada with the YMCA. I also understand that I/my child will need to bring our passport to camp if the trip involves such travel to Canada.
  4. I hereby acknowledge that the YMCA will assume that either parent of the child may pick up the child at any time during the program unless there is pertinent court documentation on file at the YMCA that indicates otherwise.
  5. I agree to the release of any records necessary for treatment, referral, billing, infectious disease tracking, or insurance purposes. The YMCA receives medical information on campers/participants that may need to be shared with medical providers, insurance carriers, or other governmental agencies as required.
  6. If I or my child requires use and administration of an epi-pen, prescription or over the counter medication, it is my responsibility to ensure that the epi-pen and/or medication are on me or my child or within our personal belongings every day of the program. If YMCA staff is required to administer and use the epi-pen and/or medication, I agree to forever release and discharge the YMCA and its directors, officers, and employees from any and all liability arising out of or resulting from use or administration of the epi-pen and/or medication.

Wilderness Trips and Participation

I give permission for myself or my child to enter Canada or other international location as designated by participation in the program. I also understand that I/my child will need to bring our passport with if the trip involves international travel.

Nothing in this Acknowledgement and Assumption of Risks and Release and Indemnity Agreement shall be interpreted as the participant and parent releasing the YMCA and the Releases from liability for injuries, damage, death, or other loss to participant or others that may occur within the jurisdiction of the National Park Service and is caused by YMCA negligence, gross negligence, recklessness, or intentional conduct, including but not limited to any negligence with respect to the YMCA judgements and decisions, or YMCA failure to take reasonable precautions to ensure it provides defect-free equipment.


General 

  1. I hereby release all pictures and video of myself or my child taken by the YMCA for promotional purposes and programming materials including the YMCA website.
  2. I give my permission for the YMCA to administer sunscreen as needed.
  3. I acknowledge that certain sections of this waiver may not apply to me and/or my child and the programs or activities that we have chosen but agree to be bound by any applicable language.

By signing this document, I agree that if I or my child is hurt or our property is damaged during participation in these activities, then I or my child may be found by a court of law to have waived our right to maintain a lawsuit against the parties being released on the basis of any claim for negligence.

I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me or that the cost to engage in this activity would be significantly greater if the YMCA did not utilize waivers as a method to lower insurance and administrative costs. I have read and understood this document and I agree to be bound by its terms.


PARENT OR GUARDIAN ADDITIONAL AGREEMENT
(For participants under the age of 18)

In consideration of being permitted to participate in YMCA activities, I further agree to indemnify and hold harmless Releasees from any claims alleging negligence which are brought by or on behalf of minor or are in any way connected with such participation by minor.

Credit Card Authorization/Payment Terms

Program cost you see in your Shopping Cart reflects current pricing, including discounts if registering during a promotional period. Child care and camp program fees, as well as future charges or change fees, will be automatically charged to the credit card you provide at checkout online. Automatic EFTs are run on Tuesday evenings.

For School Release Days, Summer Programs, Day Camp, and Overnight/Wilderness Camp, you may choose to pay in full at time of registration online. Aquatics, Youth Sports, Fitness & Wellness, and some other programs are paid in full at the time of registration with no option to pay later. 

Balances for child care (ECLC/preschool, School Age Care, Release Days, Summer Child Care) and Day Camp or Summer Sports payments are due one week prior to the week of program for the days/sessions your child will attend.

Balances for Overnight Camp, Wilderness Camp, and summer Family Camp reservations are due in four monthly installments on February 15, March 15, April 15, and May 15 unless you have a pre-arranged payment plan established with the Customer Service Center.


Personal Pricing Plan Scholarship Assistance

Each year, the YMCA of the North raises funds through the Annual Community Support Campaign. Without the support of donors, the personal pricing scholarship program would not be possible. One of the most valuable ways we keep donors committed is to say "thank you!" Our donor have said time and time again that receiving a thank you note from a recipient of a personal pricing scholarship is the most meaningful form of thanks they can receive. We encourage you and your child(ren) to write a thank you note describing what the program experience has meant to your family.


YMCA Member, Participant, and Guest Code of Conduct - all programs

Our membership code of conduct embodies the spirit of the Y, and is intended to help everyone including members, participants, and guests feel welcome and safe at the YMCA.

As a member, participant or guest, you agree to follow our code of conduct which is rooted in the values of caring, honesty, respect, responsibility and equity.  That’s why the following personal conduct is prohibited in all YMCA facilities, programs, and online communities:

  1. Inappropriate attire. Appropriate attire must be worn at all times. No clothing with vulgar language, obscene gestures, racial slurs, or anything that contributes to a hostile environment or would be considered inappropriate in a family facility.
  2. Inappropriate language. Hostile or vulgar language, including swearing, name-calling or shouting.
  3. Threatening physical contact. Physical contact with another person in any hostile or threatening way including but not limited to “play fighting”.
  4. Sexual activity. Any demonstration of sexual activity or sexual contact with another person.
  5. Harassment / intimidation. Harassment or intimidation by words, gestures, body language or any menacing behavior that demeans another person or culture.
  6. Theft / destruction of property. Theft or behavior that results in the destruction of property.
  7. Weapons. Carrying or concealing any weapons or devices or objects that may be used as weapons (including items that appear to be real).  The YMCA bans all weapons on premises with or without a permit.
  8. Illegal chemicals or alcohol. Using or possessing alcohol or drugs on YMCA property, in YMCA vehicles, or at YMCA sponsored programs.
  9. Inappropriate conduct. Any other conduct of an inappropriate, threatening or offensive nature. 
  10. Loitering. Loitering is not permitted in or outside YMCA facilities or programs.
  11. Inappropriate cell phone activity. Cell phone or photographic/video equipment use of any kind – organizing playlists, music, texting, camera functions, video recording – is not permitted in the locker rooms at any time.  Phone calls are not allowed in fitness areas.
  12. Tobacco. The use of tobacco or tobacco-like products, including e-cigarettes, are not permitted in or outside YMCA facilities or programs, or on YMCA property or program sites. YMCA facilities, ground, and vehicles are a tobacco-free environment.
  13. Social Media. Use of social networking websites in a manner that is contrary to the YMCA’s mission, is detrimental to the community or is in violation of the law.

If a member, participant or guest feels uncomfortable in confronting someone directly about offensive behavior or other issues that are in violation of the code of conduct they should report the behavior to a YMCA team member.

Suspension or termination of YMCA membership may result from a violation of this Code of Conduct. While an incident is being investigated, the membership of the person(s) accused of violating this Code of Conduct may be temporarily suspended pending a final decision.

To create and maintain a space that embodies our core values, the Y is serious about being clear regarding activities that are not allowed. If you or your invited guests violate this code of conduct, consequences can include termination of membership or program privileges. The YMCA reserves the right to make situational decisions based on its mission and values.

Terms and conditions of the Association defined programs are subject to change. I agree to abide by the current policies and procedures and the code of conduct, and agree to abide by the rules and policies of the YMCA, including any future changes approved by the governing bodies in accordance with its Charter and Bylaws.

I represent that I have adequate insurance to cover any injury or damage I or my child may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I/my child have no medical or physical conditions which could interfere with our safety in these activities, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
  5. In the event that I file a lawsuit, I agree to do so in the state where Releasees’ facility is located, and I further agree that the substantive law of that state shall apply.
  6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
  7. I agree to take personal responsibility for myself and my family while participating in this program.  Personal responsibility may include but not be limited to; initial temperature monitoring upon arrival, self-monitoring temperatures each day, following social/physical distancing protocols, and following appropriate hand-washing, cleaning and sanitation practices as defined by the camp and for as long as this is deemed necessary for the safety and protection of all participants and YMCA team members by the MDH and the CDC.

REGISTRATION AGREEMENT

STUDENT AGREEMENT

As a participant in Minnesota YMCA Youth in Government, I realize that such a privilege involves certain responsibilities. I have read and agree to abide by the Code of Conduct, understanding that all rules and regulations exist for the good of the program. I further understand that if my conduct does not meet these standards, I relinquish the right to all program opportunities and I may be returned home immediately, at my own or parents’ expense without refund of fees or other amounts paid. I acknowledge that my participation in Minnesota YMCA Youth in Government programs indicates personal acceptance of the Code of Conduct and all program rules. I have read this registration agreement; have read the Code of Conduct and agree to the terms in each document.

PARENT AGREEMENT

I hereby authorize my child to participate in all activities of Minnesota YMCA Youth in Government and authorize my child to be absent from school during the days of the session. I understand that my child will participate in various meetings and program events; will travel to the meeting facilities and other sites as designated; and reside in a designated hotel under the supervision of his/her local Youth in Government delegation advisor.

I understand that some of my child's biographical data may be included in a participant directory for distribution to other delegates, adult advisors, program sponsors and others. I understand that all photos, images and recordings (audio, visual and others) are property of the YMCA of the North; that they can be used hereafter without further permission, which may include use for promotional purposes, marketing materials and YMCA websites. I have read this registration agreement; have read the Code of Conduct and agree to the terms in each document.

In consideration of participating in Youth in Government activities and for other goods and valuable consideration, I hereby agree to release and discharge from liability arising from negligence, the local Delegation, the YMCA of the North and their owners, directors, officers, employees, agents, volunteers, participants and all other persons or entities acting for them (hereinafter collectively referred to as “Releasees”, on behalf of myself and my children, parents, heirs, assigns, personal representative and estate and also agree as follows:

  1. I acknowledge that participating in these activities involves known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death and property damage. Risks include but are not limited to broken bones, torn ligaments or other injuries as a result of falls or contact with other participants; medical conditions resulting from physical activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.
  2. I expressly accept and assume all of the risks inherent in these activities or that might have been caused by the negligence of the Releasees. My child’s participation in these activities is purely voluntary and we elect to participate despite the risks. In addition, if at any time I believe that even conditions are unsafe or that my child is unable to participate due to physical or mental conditions, then I will immediately discontinue participation.
  3. I hereby voluntarily release, forever discharge and agree to indemnify and hold harmless Releasees from any and all claims, demands or causes of action which are in any way connected with my child’s participation in these activities or our use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct or conduct that constitutes greater than ordinary negligence. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  4. In consideration of my child being permitted to participate in these activities, I further agree to indemnify and hold harmless Releasees from any claims alleging negligence which are brought by or on behalf of my child or are in any way connected with such participation by my child.

I UNDERSTAND THAT THE DEPOSIT IS NOT REFUNDABLE AND THAT INSTALLMENT PAYMENTS ARE NOT REFUNDABLE AFTER THE RESPECTIVE PAYMENT DEADLINE HAS PASSED - AND THAT NO FEES OR OTHER AMOUNTS PAID WILL BE REFUNDED IF MY CHILD IS SENT HOME FOR DISCIPLINARY REASONS.

The YMCA of the North is committed to the elimination of disparities and eradication of unjust systems to become a multicultural, anti-racist, and anti-oppressive organization as we serve all. We do not and shall not discriminate on the basis of Individuals' differences in age, color, abilities, ethnicity, family or marital status, gender Identity or expression, language, national origin, physical and mental ability, political affiliation, race, religion, sexual orientation, social-economic status, veteran status, and other characteristics that make each Individual unique.

The purpose of this Code of Conduct is to identify behaviors that protect participants and the welfare of programs for future generations. Everyone is expected to behave in mature and responsible ways and to respect the rights and dignity of others.

Participants, advisors, volunteers, staff, and board members of the YMCA Center for Youth Voice programs agree to uphold the following CODE OF CONDUCT:

PERSONAL CONDUCT

1. Each person will conduct themselves in an orderly and responsible manner in transit to and from, and during all functions with the knowledge that personal behavior reflects upon the quality of the program, the YMCA, one's delegation, one’s school and one's self.

2. Participation in all elements of the program will be maintained on an intellectual and productive level. Each participant will attend all scheduled program functions, activities, meetings and training sessions.

3. The use or possession of electronic devices is limited during program activities.

  • Devices must be turned to “silent” or “vibrate” during program activities and official functions.
  • Personal computing devices may be used in program area functions, for program-related purposes
  • Electronic devices may not be used for entertainment purposes during program functions.
  • Limited use of social media for program functions is permitted, unless overused or abused.
  • Use of anonymous social networking apps is highly discouraged. Posting derogatory comments on social platforms is not within YMCA values and is not acceptable.

4. Harassment or intimidation by words, gestures, body language, use of social media or other behaviors will not be tolerated. This includes angry or vulgar language, physical contact with another person in an angry or threatening way and posting social media content or any other conduct of a hurtful, threatening or offensive nature.

5. Sexual activity, sexual conduct, sexual misconduct or other sexually explicit activity is not acceptable and will not be tolerated.

6. Participants are expected to conform to all regulations on the honor system. Those who are present when a violation occurs and who do not intervene or report the situation may be considered a participant in the violation and may be disciplined accordingly.

7. Participants are encouraged to be responsible for their personal comfort and safety – to respectfully ask any person whose behavior is problematic to refrain. If a participant feels uncomfortable in confronting the person directly, they should report the behavior to any advisor or the State Office.

SAFETY

8. Participants and advisors are NOT allowed in each other’s lodging rooms at any time, for any reason. The only people permitted in a lodging room are those officially registered to that room (with the exception of advisors conducting room checks).

9. Lodging room switches will not be permitted without the approval of the Delegation Director and the State Office.

10. Participants will observe quiet hours and remain in their assigned lodging facility room by the curfew listed in the official program schedule. Curfew will remain in effect until 6:00 AM the following morning.

11. The use, possession or concealment of certain materials is forbidden. These materials include, but are not limited to:

  • Flame producing devices – lighters, matches, incense, candles, etc.
  • Tobacco products, e-cigarettes/nicotine and alcoholic beverages
  • Illegal drugs or chemicals – including but not limited to misuse or sharing of prescriptions or over-the-counter drugs
  • Weapons/objects that may be used as weapons or pornography

12. No participant will leave a program function without the approval of the Delegation Director AND the State Office.

  • Participants will not leave the lodging facility except while in transit to or from an official program function.
  • Should a participant need to leave for a parent/guardian-approved function outside of a conference, the participant must provide written authorization to the Delegation Director and be picked up/returned as designated by the parent or guardian.
  • Participants may not use or be transported in private vehicles during any program function without written approval of parent or legal guardian and approval by Delegation Director and the State Office.

13. Alumni, parents and official observers to any program function are restricted to public meeting spaces, lobbies and visitor’s galleries
unless approved by the State Office. They must check in at the State Office to receive credentials.

14. Alumni, parents, friends, etc., are not permitted in the lodging facility during evening activities unless approved by the State Office and
are not permitted in sleeping rooms at any time. Participants will not invite or receive visitors.

FACILITIES

15. Candy, gum, food and beverages are prohibited in all meeting rooms and facilities at all times. Water and water bottles are only permitted in hallways or public areas of meeting facilities.

16. Theft or behavior that results in the destruction of property will not be tolerated. Each person is legally and financially responsible for any removal, defacing or damage to public or private property. This includes but is not limited to the property of participants, advisors and staff, organizations, businesses, lodging & conference facilities, and the State of Minnesota.

17. Property or materials in any facility must not be removed or tampered with in any manner.

18. The lodging facility pool may not be used during conference events.

19. All individual, group or delegation meetings must take place in the lobby or on the meeting room levels of the lodging facility. No sessions or meetings of any kind may take place in the sleeping rooms of the lodging facility, nor in any hallway of the sleeping room levels of the lodging facility.

DRESS CODE

20. Nametags will be worn at all times when outside assigned lodging facility rooms. Nametags will be worn visibly on the front of the upper torso. Nametag switching/sharing is prohibited. Nametags are not to be defaced, decorated or altered in any way.

21. Professional, business dress is expectated during program activities and official functions. Clothing choices should reflect preparation for a job interview or work in government service. Appearance should be neat and tidy, with good grooming, shirts tucked in, etc.

Participants and advisors will adhere to dress code expectations at all times and are expected to bring appropriate attire to events. Those not in appropriate dress will be asked to change clothes. Not having any other clothes is not an acceptable reason for not being compliant to dress code expectations – delegates and advisors dressing inappropriately may be asked to borrow appropriate clothing.

Examples of Professional Attire:

  • Collared dress shirt (including button-downs, blouses or polos)
  • Sweaters, suit vests, suit coat, blazers, ties
  • Dress pants (including khakis), dresses, skirts, belts, suspenders
  • Dress shoes are required to be worn all day – flat shoes/low heels are good choices

Examples of Casual Attire:

  • T-shirts, sweatshirts
  • Jeans/denim in any form, corduroys, shorts
  • Tennis shoes, sandals, most closed-toe footwear

Inappropriate anytime outside hotel rooms:

  • Any clothing with vulgar language or imagery
  • Tube tops or bare midriffs
  • Pajamas or any other sleeping attire
  • Slippers or bare feet

 

  • Cultural or religious dress always fits within dress code standards; appropriation of cultural dress is not permitted.
  • Hats are only permitted in outdoor settings.
  • Pay attention to conditions – dress for the weather, transportation and terrain, including coats and footwear.

This Code will be in effect at all Center for Youth Voice functions – at the delegation level and at state program events (including transit to and from events). It will be enforced by all advisors, with discretion to the State Office.

Participation in Center for Youth Voice programs indicates personal acceptance of this Code of Conduct. Failure to follow the Code of Conduct
may result in one or more of the following disciplinary actions (but not limited exclusively to them):

A. The loss of privileges or position
B. Parents of the participant notified
C. Removal from the program/sent home at participant/parent expense - without refund of fees
D. School officials notified
E. Summoning of security and/or police

While any of the above actions may be applied to any Code of Conduct infraction, option “C” above is the most common disciplinary action for many situations.


PARENT OR GUARDIAN ADDITIONAL AGREEMENT  

In consideration of <minor youth under age 18> being permitted to participate in this activity, I further agree to indemnify and hold harmless Releases from any claims alleging negligence which are brought by or on behalf of minor or are in any way connected with such participation by minor.

Payment Terms/Credit Card Authorization

Delegation Fees

  • For most groups, there is a State program fee and a Delegation program fee.
  • For YMCA of the North delegations, these fees are combined and paid together through the online registration system.
  • For all other Delegations, these are paid separately.
    • State fee is paid through the YMCA of the North registration system.
    • Delegation fee varies by group and is payable directly to the Delegation Director.

Making Payments

  • Deposit is required at registration, via credit or debit card.
  • By providing a card to us, you are authorizing the remaining balance to be drawn from your account via EFT payments on dates determined prior to program start. Contact your Delegation Director for payment dates.
  • If alternate payment methods are needed for the final balance, these must be communicated in writing (email is acceptable) to the Delegation Director at least one week prior to balance payment due date(s).

Cancellation / Change Policy

  • Cancellations will not be accepted after March 1, when all fees and rosters are final. The deposit is non-refundable at any time. Once a payment date has passed, that amount is non-refundable and non-transferable, but any future fees due will be waived.
  • Cancellations must be made in writing (email is acceptable) to your local Delegation Director. Delegation Directors will communicate cancellations to the YIG State Office. If a participant has a significant discipline issue or violation of the Code of Conduct, Minnesota YMCA Youth in Government reserves the right to dismiss the participant, without refund, for the remainder of the session.

Personal Pricing

Personal Pricing applications must be completed in writing and submitted with supporting financial documents (as outlined in the application materials) to the YIG State Office. Personal Pricing applications are due by February 15.

  • Deposits are required for all registrations, including those with Personal Pricing requests. (If an amount less than the required deposit is needed, please contact your local Delegation Director for alternate registration method.)
  • All adults in the household must be reflected in the application.
  • You will be responsible for full payment until you receive notification of decision related to Personal Pricing request. Funds are limited and available on a first-come, first-served basis.
